1. Agreement to Terms
These Terms of Service ("Terms") govern your use of https://precisionplumbingsolution.com (the "Website") and the plumbing, gas-fitting and related services provided by Precision Plumbing Solutions ("we", "us"), based at 2 Freeman St, Lynnfield, MA 01940. By using the Website or requesting services you agree to these Terms. If you do not agree, please do not use the Website or our services.
2. Use of This Website
You may use the Website for lawful purposes only. You agree not to submit false or misleading information through our forms, interfere with the Website's operation, or use automated tools to scrape or overload it. Information on the Website is general in nature and does not replace an on-site assessment by a licensed plumber.
3. Service Estimates and Quotes
Estimates are provided free of charge and are based on the information available at the time, including anything you tell us by phone or through the Website. A written estimate is valid for 30 days unless otherwise stated. Final pricing may change if the scope of work changes, if concealed conditions are discovered (for example corroded pipe behind a finished wall or a failed component that could not be seen until the system was opened), or if you request additional work. We will tell you about any change to the price before proceeding with additional work.
4. Project Work
- All work is performed by or under the supervision of a licensed Massachusetts plumber and, where applicable, a licensed gas fitter, in accordance with 248 CMR (the Massachusetts Uniform State Plumbing Code) and the Massachusetts Fuel Gas Code.
- Where a permit and inspection are required, we obtain the permit and schedule the inspection. Permit fees are itemized on your estimate or invoice.
- You are responsible for providing safe access to the work area, disclosing known hazards, and ensuring water, gas and electrical shut-offs can be reached.
- Emergency and after-hours calls are performed on the same price-before-work basis as scheduled work; we quote the emergency rate before starting.
- Schedules are estimates. Weather, material availability, inspection scheduling and emergency calls may affect timing; we will keep you informed.
5. Warranties
We warrant our workmanship against defects for a period stated on your invoice or, if none is stated, for one (1) year from completion. Materials and equipment carry the manufacturer's warranty, which we pass through to you; we will help you make a manufacturer claim where we installed the product. The workmanship warranty does not cover damage from misuse, freezing where heat was not maintained, work performed by others, normal wear, pre-existing conditions we identified and you declined to address, or Acts of God. Warranty service is provided during normal business hours.
6. Payment Terms
Payment is due on completion of the work unless a written agreement provides otherwise. Larger projects may require a deposit for materials and progress payments as stated on the estimate. We accept the payment methods listed on your invoice. Unpaid balances may accrue interest at the maximum rate permitted by Massachusetts law and may be subject to collection costs and, where applicable, a mechanic's lien under M.G.L. c. 254.
7. Cancellation
You may cancel a scheduled appointment without charge by calling (978) 317-1244 before we are dispatched. Special-order materials that have been purchased for your project may be non-refundable. Under the Massachusetts Home Improvement Contractor law and the FTC Cooling-Off Rule, you may have the right to cancel certain contracts signed at your home within three business days; any such right is stated on the contract itself.
8. Insurance Claim Work
Where work relates to an insurance claim (for example burst-pipe or water-damage repairs), you remain responsible for payment regardless of the insurer's decision. We will provide documentation, photographs and invoices to support your claim on request, but we do not negotiate with insurers on your behalf and cannot guarantee coverage.
9. Limitation of Liability
To the fullest extent permitted by Massachusetts law, our liability for any claim arising from our services is limited to the amount you paid for the specific work giving rise to the claim. We are not liable for indirect, incidental or consequential damages, including loss of use, except where such liability cannot be limited by law. We carry liability insurance; a certificate of insurance is available on request.
10. Intellectual Property
All content on the Website — text, photographs of our work, graphics and the Precision Plumbing Solutions mascot and name — is owned by Precision Plumbing Solutions or its licensors and may not be reproduced without written permission. Job-site photographs are published with the property owner's permission and never identify a customer's address.
11. Privacy
Your use of the Website is also governed by our Privacy Policy, which explains what information we collect through our forms and how it is used, including your consent choices for email and SMS.
12. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts without regard to conflict-of-law rules. Any dispute that cannot be resolved informally shall be brought in the state or federal courts serving Essex County, Massachusetts. Before starting any legal action you agree to contact us at lafauciplumbing@gmail.com and give us a reasonable opportunity to resolve the matter.
13. Changes to These Terms
